How Defamation Claims Can Impact
Misconduct Investigations and Outcomes

Investigating claims of misconduct by a religious leader/teacher is one of the most challenging obligations that a spiritual community can undertake. One challenge organizations often encounter in investigating misconduct claims is the threat of legal action by the accused individual, who may threaten to bring a defamation lawsuit against the organization, the board or ethics committee members, or the accuser.  Even where such claims may  have little to no merit as a matter of defamation law,  the threat of litigation  is often deployed as a strategy to stall and/or shut down misconduct investigations and limit accountability.  It can also silence victims of abuse.

Join us for a conversation about defamation law with two attorneys: Emma Diamond Hall of Morgan, Lewis & Bockius LLP and Carol Merchasin, retired, former partner in the Philadelphia office of Morgan, Lewis and Bockius. While this webinar will not offer legal advice, it will provide a basic primer on the legal framework to evaluate defamation claims and a discussion of related strategic implications spiritual communities should consider in speaking publicly about misconduct investigations.
